NONIMMIGRANT : TEMPORARY STATUS : VISAS

There are countless types of non-immigrant visas that you can apply for based on the purpose of your visit to the United States, such as B1/B2 for Visitors and Tourists, F-1 for Students, H-1B for Specialty Occupation Workers, L-1 for Intracompany Transferees, U-1 for Victims of Qualifying Crimes, and many, many, more.

IMMIGRANT : PERMANENT STATUS, EMPLOYMENT BASED: GREENCARDS

There are five Employment-Based classifications under which someone can apply for Legal Permanent Residency (also known as “Greencard” or “LPR Status”).

First:  Priority Workers:  This classification includes persons with Extraordinary Ability and Multinational Managers/Executives.

Second:  Members of the Professions Holding Advanced Degrees or Persons of Exceptional Ability (National Interest Waiver).

Third:  Skilled Workers, Professionals, and Other Workers.

Fourth:  Certain Special Immigrants such as Religious Workers.

Fifth:  Employment Creation. This classification is the EB5 program, where candidates invest a certain amount of money into an individual business or regional center (pre-approved Immigrant plan) and create jobs in the US economy to qualify.

IMMIGRANT : PERMANENT STATUS, FAMILY BASED

Immediate relatives (Parents, Spouses and children under the age of 21) of US Citizens do not have to wait for a priority date to process their residency applications. However, everyone else, depending on their country of nationality may have to wait between filing relevant applications.  Non-immediate relative categories include:

    • First: (F1) Unmarried Sons and Daughters of U.S. Citizens.
    • Second (F2): Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents.
      • (F2A) Spouses and Children of Permanent Residents:  77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;
      • (F2B) Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents:  23% of the overall second preference limitation.
    • Third: (F3) Married Sons and Daughters of U.S. Citizens.
    • Fourth: (F4) Brothers and Sisters of Adult U.S. Citizens.
